US extends work duration for international STEM students to 3 years
USCIS has updated its policy guidelines for OPT for foreign students studying STEM programs in the US.
US Citizenship and Immigration Services (USCIS) has revised its policies for Optional Practical Training (OPT) for foreign students enrolled in the Science, Technology, Engineering, and Mathematics (STEM) fields.
USCIS updates have brought new opportunities and clarity for students who are interested in working in the US after completing their STEM studies.
One of the key updates is the OPT duration which is increased to 3 years as compared to other fields where one can work only for one year post their studies. It offers more time for students to get experience in the US. There is more flexibility even if one is pursuing a course online. The students can now include up to three online credits per term with their full course without violating the F1 visa terms, as reported by Business Standard.
OPT eligibility, other details
To be able to qualify for the 24-month STEM OPT extension, the student must have completed their STEM degree from a US Department of Education-recognised agency's accredited school, have a valid period after OPT, and work for an employer enrolled in E-Verify.
As per the new update, students can be eligible for post-completion OPT like students completing doctoral, master's and bachelor's degrees. It is also beneficial for students doing shorter courses including two-year programs. Students can also transfer between schools. The only condition is both the institutes should be certified by the Student and Exchange Visitor Program.
Those who complete OPT, get a 60-day grace period to change their education level, apply for a different visa status or transfer to another school which is SEVP-certified. The employers also have the option to sponsor the H-1B visa of the STEM student.
OPT Updates: More Details
The students are allowed to be unemployed during their initial OPT period for a period of up to 90 days. Those who are on the 24-month STEM extension can get 60 more days, totalling it at 150. Those who want to apply for an extension must file - the employer's E-Verify details and Form I-765 with the correct fee, a copy of the STEM degree and Form I-20.
