Who Needs a UK Work Visa?

You may be allowed to live and work in the UK even without having a visa if:

  • You are a British citizen holding a British passport, or
  • You are an eligible Commonwealth citizen; there are two clauses to it:
    • You have the right of abode in the UK if your parents or spouse has the right to abode (right to live and work without needing a visa or going through immigration restrictions) in the UK.
    • You belong to the Windrush Generation, which enlists people who arrived in the UK before 1989, or people (and their children) who arrived in the UK before 1973 from a Commonwealth country.

If none of the above cases stands true to you, then you will be required to apply for a work visa to work and live in the UK. However, if you feel that you have the right of abode, then you must apply for a Certificate of Entitlement in the UK.

What is a Skilled Worker Visa UK?

The UK Skilled Worker visa, which was formerly the Tier 2 General visa, is a sponsored route for foreign nationals to live and work in the UK for an approved employer. Foreign nationals who have completed their education within the UK and are currently living either on the UK student visa or a Graduate Visa, and the foreign nationals who are coming to work from outside of te UK - both can apply for this visa. The major condition for the same is that you must find for yourself an approved employer who is able to and ready to sponsor you for the UK Skilled Worker Visa route and provides you a "Certificate of Sponsorship". You will need the Certificate of Sponsorship when you apply for the visa.

For international students in UK switching to this visa from the Graduate Visa, it requires a job offer at a specific skill level (minimum RQF level 3+), minimum salary thresholds (usually
£41,700 or the going rate) and B1 English proficiency. International students on a post study work visa in UK do not need to show proof of English proficiency at this stage.
Important Note:- Your job must be on the list of eligible jobs for this visa.

How long can One Stay on a Skilled Worker Visa UK?

The general term of validity of your UK Skilled Worker Visa is 5 years. When it expires, you will need to either apply for the extension of its validity or switch to another visa type - mostly PR in the UK. You will also need to apply to extend or update your UK work visa in case you change your jobduring its validity.

Note - If you don't want to settle in the UK, you can apply for an extension of your UK work visa for as many times as you want until you run out of meeting the eligibility requirements. However, if you wish to settle in the UK and avail benefits like - having the rights to live, work and/or study without any restrictions, then, you might want to switch from a Skilled Worker Visa to an "Indefinite Leave to Remain" permit, also called the PR in the UK. A PR in UK can be achieved after successfully completing 5 years on a UK work permit visa on given conditions.

A:

Since applicants need to pay for a minimum of three years when applying for a Skilled Worker Visa in the UK, applicants with a job offer with lesser in length than that keep looking for a UK work visa that's valid for only 2 years.

For that reason, one can apply for a "India Young Professionals Scheme visa". This visa allows Indians from 18 to 30 years old to work in the UK for 2 years. The only conditions for getting this visa include-

Q:   Will my visa fee be refunded if I work only 1.5 years in the UK on a Skilled Worker Visa?
A:

UK's Skilled Worker Visa's fee is not refunded upon its grant and usage. The Skilled Worker Visa in the UK is granted for a minimum of 3 years once you start using it, its fee along with the IHS fee become non-refundable.
However, if you work in healthcare roles, then, you might get an automatic IHS refund for working about 6+ months or if your visa was shorter than applied for.

A:

Students applying from outside the UK need to pay the following UK work visa fee -
