Generally applicants are considered by default and the most meritorious ones are considered. There is no negative marking in both the tests. How gre is a bit tricky. In a way that it doesn't directly penalize but indirectly it does. The first 20 questions decide on the set of other 20 questions. If majority of your first 20 questions are incorrect then the other 20 will be easy questions and you score less on answering easy questions correct.

Most of the scores are valid up to 2 years from the date you took the exam. Every country has different criteria and different requirements of the score for admission.
