Hello Sanjeev,
Lateral admission directly to second year of engineering is based on similarity of subjects. Normally every state publishes a table that gives information as to which branches of Diploma can get a student admission in which branch of engineering. You should look this up on the website of the DTE of technical education of your state.

From your information it seems that you have not yet passed your engineering graduation examination. It's okay. A student is allowed to appear for GATE examination even if he is in the final year & you can definitely be considered to be in final year. Hence I feel that you are indeed eligible to appear for this examination. However to help you further I am attaching a link that will give you in detail all the different eligibilities for appearing in this examination. https://www.shiksha.com/engineering/articles/gate-eligibility-2021-age-limit-academic-qualification-blogId-21133
