Bombay HC asks BCI to take back the directives to Mumbai University on law colleges' results
On Monday, Bombay High Court said that Mumbai University's (MU) decision to cancel the results of law courses announced earlier is 'unjustified'.
The court has also slammed the Bar Council of India (BCI) for its new directives to MU, which led to the nixing of law results. As per the BCI's latest directive, the Mumbai university decided to withdraw the previously announced results of law courses that were based on the average scores of previous semesters. MU was replacing the results with the ‘assignment-based evaluation’ which could not happen last year due to the pandemic and the high court is clearly not convinced.
A division bench of Justice R I Chagla and Justice R D Dhanuka stated, “We are of the prima facie view that the results which are already declared on May 22, 2020, in respect of various semesters referred in the circular dated July 5, 2021, could not have been withdrawn and the students could not have been directed to submit assignments for the purpose of further evaluation.”
The petitioner, a final year student of Government Law College (GLC), Mumbai, challenged the university's circular dated July 5 which suggested that the earlier announced results would be cancelled for an assignment-based evaluation.
The court has asked BCI to either consider or the court will grant a stay on the MU circular. BCI will inform the court on July 28 if the directives can be modified or cancelled.
