UPSC aspirants move to Supreme Court for extra attempt

UPSC IAS 2022 prelims exam will be conducted on June 5. Some candidates who missed appearing in the Civil Service (IAS) main exam 2022 were conducted in January 2022. Three candidates who cleared the IAS prelims exam could not appear in some papers of the IAS main exam because they were contracted with COVID-19 infections in the middle of IAS main exam and there were severe restrictions for such patients by the Government of India.

The petitioners urged the court that they should be provided with the opportunity to appear in the IAS main exam as they may do so because they had cleared the UPSC IAS prelims exam 2022. The petitioners contended that Union Public Service Commission (UPSC) had no policy guidelines for such candidates who were Corona positive during the IAS main exam. UPSC released the admit card for the main exam but did not release any guidelines for the candidates suffering from the COVID-19.

UPSC did not issue any such guidelines to include the COVID-19 suffering patients in the UPSC exam centres for appearing in the exam. They contended that this lack of proper guidelines, policy directives and arrangements have infringed their right to equality guaranteed under Articles 14 and 16. This implied that UPSC cannot discriminate against them just because they were contracted with the COVID-19 infection.

Petitioners are urging the apex court to issue directives to UPSC to provide them additional/extra attempts and also plan for the petitioners to appear in the rest of the Civil Service (IAS) main exam papers which the petitioners could not give before the publication of Civil Service (IAS) main exam result 2021. The court has asked the respondents to submit an affidavit in this regard.
