Delhi HC has decreed that students who leave their IIT course after confirming admission cannot be allowed to reappear for IIT JEE next year.

Dismissing a plea by Mr. Prateek Rohilla, the Delhi High Court decreed that he cannot be allowed to reappear for IIT JEE 2012 as he was already granted admission to IIT Madras and left the course midway after paying the registration fee last year.

The court said that if a student withdraws after confirming admission, the precious seat allocated to him gets wasted not only in the first year but right up to the time the course is finished. In this case, the seat had been kept vacant for five years. This is not only unjust for other students vying for a seat but also puts immense financial strain on the institute.

Mr. Rohilla qualified IIT JEE 2011 under the Scheduled Castes category and was selected for the five-year dual degree M.Tech program in Engineering Design (Automotive Engineering) at IIT Madras. He made an on online payment of Rs 20,000 as non-refundable registration fees at the institute to confirm his admission. However, he did not turn up to attend his classes and withdrew his admission.

He applied again for IIT JEE 2012 under the general category but IIT Delhi who is organising the test this year informed him that he was not eligible as per clause 3.5 of the information brochure of IIT-JEE-2012. The clause states that ‘Candidates who have taken admission (irrespective of whether or not they continued in any of the programmes) or accepted the admission by paying the registration fee at any of the IITs, IT-BHU (Institute of Technology-Banaras Hindu University) Varanasi or ISM ( Indian School of Mines) Dhanbad are not eligible to appear in IIT-JEE-2012.'

The Delhi High Court sealed his fate by dismissing his plea and affirmed that no student should be allowed to prestigious IIT seats in this manner. Read more
