Decision awaited on NEET for MBBS/BDS admissions next year

Going by the Supreme Court's verdict announced today on July 18, 2013, there will be no unified exams for admissions to MBBS and post-graduate medical courses conducted in colleges across the country.

The confusion continues as the Supreme Court is now looking to reconsider its earlier judgement of scrapping NEET (National Eligibility Cum Entrance Test). The test was introduced last year for medical admissions across the country. Now, medical aspirants will have to wait for the final decision on whether NEET will be held in 2014 or not.

Going by the Supreme Court's verdict announced on July 18, 2013, there will be no more unified exams for admissions to MBBS and post-graduate medical courses conducted in colleges across the country. Consequently, NEET (National Eligibility Cum Entrance Test) will not continue to be conducted for medical college admissions from the next year.

However, the court also confirmed that its verdict will not affect the admissions which have already taken place this year.

A three-judge bench who gave a 2:1 verdict said that the MCI notification was ultra vires of the Constitution. Given below is the crux of the verdict made by all the three judges:

MCI is not empowered to prescribe all India medical entrance tests.

Disagreeing with the other two judges, Justice A R Dave said “Holding of National Eligibility Entrance Test (NEET) is legal, practical and is the need of the society. Hence, I have dissented.”

MCI notification was in violation of Articles 19, 25, 26, 29 and 30 of the Constitution.

It’s beyond MCI powers to make such an arrangement of common entrance test both for government and private institutions.

Following the SC ruling, state governments are likely to get back to the older system of conducting Common Entrance Tests (CET) from the next year. In a first, the Mumbai state government is all set to re-introduce its own entrance test Maharashtra State Common Entrance Test (MSCET) from the year 2014.
