Hijab Row: Appeal filed in SC challenging Karnataka HC order
The plea filed in SC by a student has sought a stay on the direction of the high court, which is hearing the hijab issue, as well as the processing going on before the three-judge bench.
An appeal has now been filed in the Supreme Court challenging the direction of the Karnataka High Court that has directed the students not to avoid wearing any religious dress on campuses of education till the court takes a final call on the hijab controversy.
The appeal has contended that the Karnataka high court has sought to curtail the fundamental right of Muslim students by not allowing them to wear the hijab. The plea filed in SC by a student has sought a stay on the direction of the high court, which is hearing the hijab issue, as well as the processing going on before the three-judge bench. The three-judge full bench of Chief Justice Ritu Raj Awashti, Justice J M Khazi and Justice Krishna S Dixit, which was formed on Wednesday, has said it wants the matter to be resolved at the earliest but till that time peace and tranquillity is to be maintained.
“Till the disposal of the matter, you people should not insist on wearing all these religious things,” Chief Justice Ritu Raj Awasthi had said. The high court has posted the matter for February 14 and also directed educational institutions can resume classes for students.
It must be noted that the case has been filed by a group of Muslim girls studying in government colleges in the Udupi district against a ban on wearing hijabs in classrooms. On January 1, a government Pre-University college in Karnataka's Udupi barred six Muslim girl students from attending classes as they were wearing hijab. The college management cited a new uniform policy behind the reason for the ban. Soon after this, other government colleges in Udupi witnessed several students protesting against a ban on hijab.
