SC Authorises Committee To Start Suo Motu Proceedings Against Private Medical Colleges

Supreme Court has backed the Kerala High Court order which gave power to the Admission Supervisory Committee to initiate suo motu action against the private medical colleges.

The top court of the country has upheld the Kerala High Court order giving power to the Fee Regulatory Committee and Admission Supervisory Committee to initiate the suo motu proceedings related to the medical admissions made by the private colleges. The Supreme Court has echoed the judgement and empowered the Committee with this power.

The SC bench comprising Justices Abhay S Oka and L Nageswara Rao noted, "We are in agreement with the findings recorded by the High Court on the powers conferred on the Committee including the power of suo motu action that can be taken by the Committee in respect of admissions made by the self-financing colleges."

The Supreme Court said this while hearing a plea challenging the scope of the powers of the Committee under Sections 4(6) and 4(7) of the Kerala Professional Colleges or Institutions (Prohibition Of Capitation Fee, Regulation Of Admission, Fixation Of NonExploitative Fee And Other Measures To Ensure Equity And Excellence in Professional Education) Act.

Earlier, Karuna medical college based in Kerala filed a petition in the Kerala High Court against the Committee's proceedings on the college, the college was not given approval for admitting MBBS (Bachelor of Medicine and Bachelor of Surgery) students in the academic session 2013-2014. The High Court stayed all the proceedings started by the Committee against the medical college subject to the condition that the college would furnish all details regarding admissions made for this academic session within a period of one week.
