Supreme Court dismisses students' pleas against Medical Council of India
The top court of India has dismissed pleas challenging NMC's decision to cancel the admission of students on allegations of backdoor entry into medical colleges.
Pleas were filed by the medical students in the Supreme Court of India challenging the order of the Delhi High Court which upheld the discharge orders passed by the National Medical Commission (earlier known as the Medical Council of India). The Supreme Court has dismissed these pleas.
A Bench comprising Justices D.Y. Chandrachud and Hima Kolhi agreed with Advocate, Mr Gaurav Sharma, appearing on behalf of NMC that the impugned order does not merit interference by the apex court, as reported by Live Law.
"This is not a case for our interference," said the bench.
Details of court's proceedings
Senior Advocate Mr Neeraj Kishan Kaul appeared on behalf of student petitioners. He submitted that the concerned students are NEET qualified and were not admitted outside the NEET counselling process. As per the advocate, the admission was not granted based on college counselling but on the basis of Central counselling and admissions were granted to these students only when the vacancies were not filled up by the state till the end.
"They have done about 4.5 years. They want to know in what direction their life is heading. In our case, factually, the Central Counselling took place; these students are NEET qualified and on the last date there were 5 vacancies. Similarly, situated students in another medical college who were also discharged were eventually absolved by the NMC," said Mr Kaul.
