Unauthorized medical seats to not receive recognized degreesAspiring to be a doctor? Study hard and get into an authorized medical college. Do not be tempted to somehow get into a college that offers extra seats beyond its allotted capacity. As per the Supreme Court ruling on Wednesday, medical degrees of students who will be admitted beyond the allotted college capacity will not be recognized. This step will disqualify such degree holders from practicing as a medical professional.

Medical colleges can increase their intake only with prior sanction from the regulatory authority Medical Council of India (MCI) and final approval from the Centre, as per Section 10 A of the MCI Act.

Three colleges in UP namely School of Medical Science and Research (Sharda Education Trust); Rama Medical College Hospital and Research Centre, Kanpur and Tirthankar Mahaveer Institute of Management and Technology, Moradabad had challenged this norm. These colleges obtained favourable orders from the Allahabad High Court to increase their seats from 100 to 150, but MCI took up the matter in Supreme Court. As per the ruling in favour of MCI, β€œWhere any medical college increases its admission capacity in any course of study or training, except with the previous permission of the Central Government in accordance with the provisions of Section 10A, no medical qualification granted to any student of such medical college on the basis of the increase in its admission capacity, shall be a recognised medical qualification for the purposes of the Indian Medical Council Act, 1956.”

The court said the permission granted to run MBBS courses needs to be renewed on a yearly basis till the college completes four years of the graduation course. It's only after getting the permission to conduct the course for the fifth year does a medical college become recognized by MCI. A medical college is entitled to seek permission for offering post-graduation courses only after it has a five year record of conducting the MBBS course.
