SC issues notice to ICSE in plea seeking adoption of CBSE's re-assessment option for Classes 9 & 11 failed students

A plea is filed against ICSE seeking the opportunity of re-assessment and promotion of ICSE students who failed the 9th and 11th standard by adopting the option given by CBSE in view of the ongoing COVID-19 pandemic situation.

The Indian Certificate of Secondary Education (ICSE) received a notice from the Supreme Court. A plea is filed against ICSE seeking the opportunity of re-assessment and promotion of ICSE students who failed the 9th and 11th standard by adopting the option given by the Central Board of Secondary Education (CBSE) in view of the ongoing COVID-19 pandemic situation.

The plea is filed by a minor petitioner of Class XI through Advocate Alakh Alok Srivastava. The notice issued by the Bench of Justices AM Khanwilkar, Dinesh Maheshwari and Sanjiv Khanna is accepted by former solicitor General Ranjit Kumar.

According to the reports, the plea states that if the ICSE does not adopt the resolution adopted by the CBSE on May 13, then many students of Classes 9 and 11 will be deprived of the right to equality as guaranteed under Article 14 of the Constitution. The petitioner also prayed that since there is a delay on the part of the ICSE to adopt the CBSE notification of May 13, the petitioner may be directly promoted to Class XII, especially amid the increasing COVID-19 cases. The plea states, "at such a difficult time, all stakeholders will have to make joint efforts to relieve students from stress and to help them to mitigate their anxiety."

On May 13, CBSE decided to provide an opportunity to appear in a school-based test again to all the failed students of 9th and 11th as a one-time measure. It was also decided that an opportunity will be extended to students irrespective of whether or not their examinations got completed and the exam results are released.

During an earlier hearing in the Supreme Court, CISCE cancelled pending ICSE Board Exams and ISC Board Exams in the view of the COVID-19 outbreak. The board also adopted an alternative assessment scheme to released ICSE Results 2020 and ISC Results 2020. The  Board declared ISC Results 2020 and ICSE Results 2020 together on July 10.
