Justice Purushaindra Kumar Kaurav, High Court of Delhi after hearing the case for more than a month pronounced judgement on April 17, 2022 in which the petitions filed by all four affiliated institutions have been dismissed by upholding the process initiated by GGSIP University for providing additional facility of online registration to the candidates who were denied opportunity to obtain forms by the affiliated institutes or enable to obtain form for any reasons, could also apply in the laid down schedule on online portal of the GGSIP University.

 

Delhi HC Upholds online process of GGSIPU for management quota seats

Guru Gobind Singh Indraprastha University in pursuance of the Directorate of Higher Education’s Order dated September 22, 2022, had provided the additional facility for online registration on the GGSIP University portal for candidates for admission in BTec Management Quota Seats as there were some complaints regarding the nonissue of forms for Management Quota Seats by the affiliated colleges.

Four colleges namely, Vivekananda Institute of Professional Studies (VIPS), Maharaja Agrasen Institute of Technology (MAIT), Maharaja Surajmal Institute of Technology (MSIT) and Bharati Vidyapeeth College of Engineering (BVCOE) had challenged the decision of Directorate of Higher Education and GGSIPU University for providing additional facility to the candidates to do online registration for admissions in Management seats on the plea that the Delhi Professional Colleges or Institutions (Prohibition of Capitation Fee, Regulation of Admission, Fixation of Non-Exploitative Fee and Other Measures to Ensure Equity and Excellence) Act, 2007 (Delhi Act 8 of 2007), only provides for admissions in Management Quota Seats by management of the self  - financing institutes. 

In addition to that, two Writ Petitions were also filed by the petitioner, a prospective candidate making allegations against lack of transparency in the Management Quota Admissions.

High Court also upholds the decision of the University in declaring admissions of B.Tech. course conducted by MSIT during 2022-23 as null and void due to failure of MSIT in carrying out admissions in contradiction to the existing provisions of law.

High Court, however, was pleased to allow the students admitted to continue in the same college on the basis of stand taken by the admitted students that due to the fault of the Institute the students cannot be made to suffer.

High Court in the Order dated 17.05.2023 dismissed all six Writ Petitions, i.e, four of the affiliated colleges challenging the University process and two Writ Petitions by individual petitioner making allegations of lacking transparency and also partially allowed the request of students admitted in MSIT to the extent that the Management Quota Seats for 2023-24 for MSIT will be treated as zero. During the current Academic Session 2023-24 the University will follow online registration process for Management Quota Seats for all the programmes.
