Supreme Court issues notice on NMC's transfer petition
Supreme Court has issued notice on NMC's transfer petition pertaining to pleas challenging NMC's directions for fees of 50% seats in private medical colleges.
The apex court has recently issued a notice in the transfer petition filed by the National Medical Commission (NMC) in relation to the pleas challenging NMC's office memorandum that suggested that the fees of 50% of seats in private medical colleges should be at par with the fee in the government medical colleges in the respective states and union territories.
The SC notice was issued by the bench of Justices DY Chandrachud and Hima Kohli and the main petition in this case and the connected matters are to be listed before the bench on November 4, 2022.
Transfer petition was suggested by SC
NMC was seeking to transfer all similar challenges pending before different high courts across the country to the Supreme Court.
On the last hearing, Justice DY Chandrachud had suggested NMC's Advocate Gaurav Sharma file a transfer petition so that the court can transfer all related matters in this regard to Supreme Court or consolidate them and send it to the Delhi High Court or any other High Court for disposal, as reported by Live Law.
The Background
The office memorandum (OM) issued by NMC on February 3, mandates that fees for 50% of the seats in private medical colleges be at par with the fee in the government medical colleges of that state. However, this faced much opposition from private medical colleges and hence many petitions were filed against NMC. Till now, only MP has implemented the NMC's guidelines for fees reduction.
