SC dismisses two pleas challenging Delhi HC judgment that upheld Centre's Agnipath scheme

The Supreme Court has declared the Centre's Agnipath scheme valid, rejecting two appeals and said the scheme is not arbitrary. The Apex Court was hearing the petition challenging the Delhi High Court's judgement upholding the Agnipath Scheme, as per which those between 17-and-a-half and 23 years of age were made eligible to apply for armed forces to be inducted for a four-year tenure.

"Public interests outweigh other considerations," the Supreme Court said. The Supreme Court said, "Candidates selected in the defence recruitment process before the introduction of the Agnipath scheme do not have a vested right to appointment."

A bench of Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala said "candidates, who earlier got selected through recruitment processes like rallies, physical and medical tests for defence forces before the introduction of the Agnipath scheme, do not have a vested right to appointment."

"Sorry, we would not like to interfere with the high court verdict. The high court had dealt with all the aspects", it said, while dismissing separate pleas filed by Gopal Krishan and advocate ML Sharma against the high court verdict.

The Supreme Court posted a third fresh plea for hearing on April 17, 2023 related to recruitment in the Indian Air Force (IAF) prior to the launch of the Agnipath scheme. It asked the Centre to file its response to the third plea related to recruitment in the IAF.

On March 27, Supreme Court had agreed to hear a petition challenging the Delhi High Court's judgement upholding the Agnipath Scheme.
