In most cases, no you can not directly take admission in third year of B.Com when you fail in the 1 st year and then you take a free year. Academic progression rules in University are normally severe. It is most likely that you would be required to re-enrol during the first year or the second year at worst, in the event that you pass your failed subjects upon the discretion of the university regarding the re-admission policy. A gap year does not automatically lead to a promotion since there is a normal practice of having a backlog of failed subjects, especially at the advanced years.
