Karnataka Hijab Row: SC issues notice to state govt over plea challenging HC's order
Supreme Court has issued a notice to the Karnataka government over a plea challenging the High Court's order supporting the hijab ban in educational institutions across the state. The Apex Court refused the request for adjournment by appellants, saying it won’t allow “forum shopping”. The Supreme Court will next hear the matter on September 5.
It must be noted that several petitions were also filed in the Supreme Court against the Karnataka High Court verdict holding that wearing of hijab is not a part of the essential religious practice which can be protected under Article 25 of the Constitution.
What is the Karnataka Hijab Row case?
In January 2022, several girl students were denied entry inside the school premises as they were wearing hijabs or headscarves. They were not allowed entry on the grounds that they are violating the uniform policy of the school.
Soon, the other institutions in the state also followed it and many Muslim students in were not allowed to appear in the exam as they were wearing hijab and they had to miss it. As Muslim students staged protests and urged authorities to allow them to wear hijabs, many Hindu students also came forward, demanding to wear saffron scarves inside their classrooms.
With the situation getting out of hand and many students missing out in their academics, a petition was filed in the Karnataka High Court challenging the uniform guidelines in the state. After several petitions were filed against the school and university dress code in Karnataka, the High Court issued an interim order restraining all students from wearing any form of religious attire while attending classes. Further, the schools in the state were shut down due to protests.
The court further banned burqas and hijabs inside the school. After which, several female students were made to remove their headscarves before entering the premises. Because of their religious beliefs, many students had to leave their education in between.
