
Rajasthan HC Bench stated that the 25% domicile reservation at National Law University Jodhpur does not violate Article 14, owing to the reasonable and non-arbitrary classification with the aim to enhance regional educational development.
The Rajasthan High Court has ratified the validity of 25% domicile-based reservation at National Law University, Jodhpur (NLUJ). The High Court bench consisting of Dr. Justice Pushpendra Singh Bhati and Justice Chandra Prakash Shrimali ratified the 25% domicile reservation in NLU Jodhpur on the grounds that the reservation does not violate Article 14 as the classification is reasonable, non-arbitrary and aims to enhance the regional educational development.
The HC bench took note of several other NLUs that already have domicile-based reservation subject to the requirements of regional academic development of their respective states and stated that the state had merely aligned NLUJ with the and said that the state had only brought NLUJ in line with the usual rules followed by other NLUs, as reported by Live Law.
The bench further quoted that adapting domicile-based reservation provision reflects an evolving national policy framework, where states funding NLUs aim to balance the institute's national character without jeopardising the needs of local students. The domicile-based reservations are in line with the equality code under Articles 14 and 15 of the Constitution of India.
The petition was filed against the notification and the NLUJ's Executive Council's Resolution passed in 2022, introducing the domicile-based reservation for students from the state. The petitioner argued that the domicile-based reservation violated Articles 14 and 15 of the Constitution, and no purpose or objective to offer such a reservation is justified.
