On Tuesday, the Centre said that Dravida Munnetra Kazhagam's (DMK) demand to increase the reservation percentage from 27% to 50% in all India quota (AIQ) medical seats would not help the Tamil Nadu medical students in a substantial way, most of the seats will go to the OBCs from other states.

Additional Solicitor General (ASG) K.M. Nataraj stated while appearing before the court that on July 20, 2020, a Bench led by the then Chief Justice A.P. Sahi had said that OBCs are entitled to reservation in AIQ but the Bench did not rule that the 50% state reservation policy should be applied while filling such quota.

He also pointed out that Supreme Court created AIQ and until 2006, it was filled up without any reservation. It was only in 2006 when Supreme Court ordered reservations for the Scheduled Castes (SCs) and the Scheduled Tribes (STs) and as per the central reservation policy SC/STs were provided 15% and 7.5% respectively.

ASG argued that TN follows the 69% reservation policy that provides 50% to OBCs, 18% to SCs and 1% to STs. He said the state government never had any issues with the quantum of reservation for SCs and STs, and it is only for OBCs reservation, the state government wants to follow the specific state reservation policy.

“Even assuming their argument is accepted, Tamil Nadu students won’t get those seats. They are arguing to the detriment of their own students and the State as well,” the ASG said.
