Supreme Court has dismissed the petition filed seeking menstrual leaves for women and students in schools and colleges across the country. The matter was heard by the Chief Justice of India, CJI DY Chandrachud today, February 24, 2023. After the hearing, the petition was dismissed accordingly. 

During the hearing, CJI said that "the matter should be heard by the Ministry of Women and Child Development. Having regard to the policy views, it would be appropriate if the petitioner approaches the women and child development ministry. The petition is accordingly disposed of."

The petition, filed by Delhi resident Shailendra Mani Tripathi, has sought direction from the Centre and all the states for compliance with section 14 of the Maternity Benefit Act, 1961. Section 14 of the Act deals with the appointment of inspectors and says the appropriate government may appoint such officers and may define the local limits of jurisdiction within which they shall exercise their functions under this law.

The PIL filed also sought the compliance and proper implementation of Section 14 under the Maternity Benefit Act, 1961. The petition also quoted a study conducted by University College London which stated that the pain a menstruating person goes through is equal to that of a heart attack.
