The Delhi High Court has directed NMC to lift the prohibition of the medical student to another college. NMC has been asked to create a proper policy in this regard as per Regulation 18 of the Graduate Medical Education Regulation, 2023. The Delhi HC has directed the NMC to take a substantial decision within three weeks.

The Bench has asked the National Medical Commission (NMC) to lift the prohibition of transfer or migration request of the medical students to another college.  The HC said that Regulation 18 of the Graduate Medical Education Regulation, 2023, stands invalid as it should be struck down. This verdict has come in the light of supporting a 40 percent visually impaired candidate who requested his migration from the Government Medical College, Barmer to a medical college in Delhi. HC has directed NMC to formulate proper policies in this regard, as the petitioner was not allowed to participate in the counselling under the PwD category after clearing NEET 2023, as per the sources. By the time he was allowed, the stray vacancy round was ongoing, leaving him with limited options to choose from for admission.

What is Regulation 18?

As per Regulation 18 envisaged in GMER, a restriction was imposed on the migration of medical students as it was prone to misuse. The candidate’s request was rejected by the NMC in December 2024 when he requested migration on the grounds that Regulation 18 had removed the migration provision entirely.

However, in this case, this regulation is denying legitimate rights to a citizen therefore, the medical condition of the petitioner will be considered as a priority. The harsh climatic conditions of Barmer were proving detrimental for his health, as per the Rights of Persons with Disabilities Act (PwD Act) it is the prime responsibility of the law to provide reasonable accommodation and appropriate environment” to the petitioner.

The HC Verdict on Case

The Delhi HC has directed the NMC to take a substantial decision within three weeks on the petitioner’s request to ensure that the transfer is carried out seamlessly.

Q:   Can a student do MBBS without NEET?
A:

Students cannot do Bachelor of Medicine and Bachelor of Surgery (MBBS) without qualifying the NEET UG exam. Clearing the NEET exam is the minimum eligibility requirement to pursue the MBBS course in India.

10. Bachelor of Audiology, Speech and Language Pathology (BASLP)

11. Bachelor of Prosthetics and Orthotics

These courses are offered at various colleges across India, and the admission is based on the NEET UG exam scores.

 

Q:   Can I appear for NEET if I forget to carry my photo ID?
A:

No, candidates will not be allowed to appear for the examination without a valid photo ID. Candidates were advised to keep the following three things ready with them, a day before the examination; a valid photo ID proof, NEET admit card, and a recent passport-sized photograph. These are the mandatory documents to be produced during entry to the NEET exam centre. The valid photo identity card which will be allowed at the NEET exam centre include Aadhaar card/ Driving Licence/ PAN Card/ Passport/ Voter Id, etc. The NEET admit card is also required to have the passport and postcard-sized photographs pasted on it.
