The economics if these institutes depends on number of students. If you are leaving, it's loss for them. Perhaps the only way is to out some political pressure to get the refund.

Yes, NIOS are now allowed to appear for NEET. From 2019, NIOS and open school students are eligible to apply for NEET.

Lateral entry is allowed to only diploma and B.Sc candidates.
Other candidates can also get entry but by direct admission only for which you have to apply for direct admission which is in the month of august only in the prescribed date after that you won't be able to get entry.
