Bombay HC stays Maharashtra CET circular stating XAT, MAT, GMAT, ATMA scores invalid for admission to MBA/MMS.
The Bombay High Court has implementation of a circular issued by Maharashtra State CET on March 16, 2020 stating that only MAH CET scores will be valid for admission to state institutions offering MBA/MMS courses. The circular had declared ATMA, MAT, GMAT and XAT scores invalid for admission.
A bench of Chief Justice Dipankar Dutta and Justice GS Kulkarni said the state should take โreasonableโ decisions regarding education โwhich would not adversely affect the candidates by any sudden change in the admission criteriaโ. The change in the eligibility criteria should have been notified well in advance, the bench opined.
Hearing the petition of three students against enforcement of the state circular on grounds of right to equality, the HC asked the State to consider eligibility of three students for admission based on XAT, ATMA, GMAT and MAT scores for admission to 2020-2021 academic year. It also said that the circular issued on March 16 could be implemented in 2021-2022 academic year.
After the Bombay HC ruling, Maharashtra State CET posted on the official notification regarding the same on its website. โWith reference to Judgement of THE HIGH COURT OF JUDICATURE AT BOMBAY CIVIL APPELLATE JURISDICTION WRIT PETITION (St) No.96887 OF 2020 on dated 11/12/2020. Process for MBA application will resume back later by adding ATMA, MAT, XAT for admission process year 20-21 , after getting permission from Maharashtra Government. Accordingly, separate notification will be publish on CET website,โ the notification stated.
The three students said they had appeared for ATMA on July 6 under the assumption that the result would be considered valid for admissions to MBA/MMS course as was previously considered by the state when students appeared for ATMA, XAT, MAT and GMAT.
