The BCI three-year moratorium on new law colleges aims to enhance the quality of legal education in India and to prevent the commercialisation of legal education, academic malpractice and persistent shortage of qualified faculty.

The Bar Council of India (BCI) has announced a three-year nationwide moratorium on new law colleges in order to curb the increasing sub-standard law colleges across India. The BCI also cited that the institutional capacity of India is adequate, with around 2000 centres of legal education currently active.  

The Bar Council of India (BCI) remarked that during the three-year moratorium, no new law colleges in India will be opened or approved anywhere in the country. The council also clarified that existing colleges will not be allowed to start any new sections, courses, or batches without BCI’s written permission for such commencement. 

The council explained that this judgment seeks to improve the quality of legal education, as many sub-standard institutions have been opening disorderly, often receiving NOCs from state governments and university affiliations without proper inspections of the institutes concerning the academics and infrastructure required for legal education in India. 

The council also stated that this decision is aimed at eliminating the commercialisation of legal education, reducing academic malpractices, and addressing the shortage of qualified faculty across the country. 

With nearly 2,000 law colleges currently functioning, the Bar Council of India (BCI) noted that the country has enough institutions to offer quality education. The focus now needs to be on enhancing quality, strengthening approaches, and ensuring better standards in legal education across the country.
