The matter was listed for hearing today on January 28. The counter-affidavit was filed by the petitioner on January 27, in response to the Centre’s affidavit for not providing an additional compensatory attempt to the candidates who did not appear in the UPSC IAS Prelims exam 2020 conducted on October 4.

The Supreme Court said that they require an affidavit from an appropriate authority, not from under-secretary. The SC said that we need to know at what level such a one time and policy decision was taken. Justice AM Khanwilkar expressed his displeasure that the affidavit submitted by the council, on behalf of Central Government, does not inform about how the decision was taken.

Senior Advocate CU Singh, submitted before the court that the students who had to give their last attempt were forced to appear in the IAS Prelims exam 2020 irrespective of their preparation as there was no clarity on the issue. In the other petition seeking postponement of the IAS Prelims 2020 exam, the centre said that it will consider providing an extra attempt. But the recent affidavit submitted by the Centre was on contrary to the previous submissions.
