Urvi Chandrashekhar Acharya, an LLM graduate with first-class honours, has taken the Bar Council of India (BCI) to the Gujarat High Court after being declared ‘Fail’ in the All India Bar Examination (AIBE). Her petition highlights that 7 out of 100 questions were withdrawn post-exam, yet no grace marks were awarded to her leaving her score out of 93 unaffected.
Despite attempting all questions and applying for re-checking, her result remained unchanged, and the BCI provided no rationale for her failing grade. Justice Niral R. Mehta has issued notice to the BCI, with arguments set for July 8, 2025, to address concerns over fairness and transparency in the evaluation process
Acharya appeared for AIBE 19 Exam that was held on December 22, 2024; results based on 93 questions, with 45 per cent (approx. 42 marks) as the passing threshold. When the AIBE 19 Result 2024 was announced, where she was declared failed, she applied for the online re-checking process and paid the applicable fee but the verdict remained unchanged
The withdrawn questions were excluded from the final evaluation, yet no adjustment for answered items was made. The BCI did not provide any explanation or show workings for the final results, prompting questions about procedural transparency. The Gujarat High Court will now revisit the BCI’s evaluation process on July 8. The case raises broader concerns about assessment clarity in the open-book AIBE.
