The Bar Council of Gujarat is an "Autonomous Statutory Body" that was formed on August 16, 1961, under the Advocates Act, 1961 to represent lawyers practicing law in Gujarat. It holds significant powers, duties and functions to comply with its statutory duties as per the Advocates Act, 1961, the Gujarat Advocates’ Welfare Fund Act, 1961 and the rules formed and imposed by the "Bar Council of India." The number of advocates is increasing in Gujarat. Thus, the number of advocates enrolling in the Bar Council of Gujarat is increasing rapidly. Bar Council of Gujarat Functions

As per Section 6 of Advocates Act, 1961, the Bar Council of Gujarat has the following functions: 

1. The functions of a State Bar Council shall be:

  • To admit persons as advocates on its roll;
  • To prepare and maintain such roll;
  • To entertain and determine cases of misconduct against advocates on its roll;
  • To safeguard the rights, privileges and interests of advocates on its roll;
  • To promote the growth of Bar Associations for the purposes of effective implementation of the welfare schemes referred to in clause (a) of sub-section (2) of this section and clause (a) of sub-section (2) of Section 7;]
  • To promote and support law reform;
  • To conduct seminars and organise talks on legal topics by–eminent jurists and publish journals and papers of legal interest;
  • To organise legal aid to the poor in the prescribed manner;
  • To manage and invest the funds of the Bar Council;
  • To provide for the election of its members;
  • To visit and inspect Universities in accordance with the directions given under clause (i) of sub-section (1) of Section 7
  • To perform all other functions conferred on it by or under this Act,
  • To do all other things necessary for discharging the aforesaid functions.

2. A State Bar Council may constitute one or more funds in the prescribed manner for the purpose of –

3. A State Bar Council may receive any grants, donations, gifts or benefactions for all or any of the purposes specified in subsection (2) which shall be credited to the appropriate fund or funds constituted under that sub-section.

Q:   Who can apply for Certificate of Practice by BCI?
A:

The candidates whose names appears on the Roll of Advocates maintained by a State Bar Council can apply for the CoP. These candidates must be enrolled advocates who have passed the All India Bar Examination.

Why do I need to register with the Bar Council of Gujarat? 

Before enrolling with the State Bar Council of Gujarat, you need to know why you need to register with this organisation. If you want to become an advocate and practice law in Gujarat, it is mandatory to register with the Bar Council of Gujarat after passing a 5-year LLB or 3-year LLB. Then, first, you will have to take and pass the All India Bar Examination (AIBE) and obtain a "Certificate of Practice" (COP). After receiving this COP, you can work as an individual advocate or a junior advocate under senior advocates. Therefore, registering with the Bar Council of Gujarat is the first step to becoming an advocate in the state.

The complete process to enrol in the Bar Council of Gujarat is mentioned below:

Documents Required for Registration with the Bar Council of Gujarat

Before enrolling in the Bar Council of Gujarat, you must have the following documents:

  • Class 10th marksheet and passing certificate
  • Class 12th marksheet and passing certificate
  • Employment certificate (if required, only for those who are / were working professionals)
  • 3-year / 5-year LLB marksheet and passing certificate
  • Latest passport-size photo in formal attire of a lawyer
  • Photo ID proof such as an Aadhaar Card, Passport or PAN Card
  • Self-attested address / residence proof
  • Rent agreement (only for those who live in a rented house in Gujarat and have the signature of their landlord on the copy of the rent agreement)
  • An affidavit justifying the gap between the passing year of a 3-year / 5-year LLB and the year of enrollment in the Bar Council of Gujarat (if any gap is there).

2. Fill out the form: Now, fill out the application or registration form in block letters (capital letters). 
3. Review and Signature: After filling out the form, review it carefully. If all details are correct, then sign in the place of "Signature of the Applicant."
4. Pay the Application: In this step, you need to pay the application fee through a bank challan.
5. Submit the Bar Council of Gujarat Registration: In the last stage of the Bar Council of Gujarat registration, applicants need to submit the registration form to the office of the Bar Council of Gujarat. This form can only be submitted offline.

Bar Council of Gujarat Registration Fee

The registration fee for the Bar Council of Gujarat is INR 6,000 for general category candidates and INR 3,000 for SC and ST category candidates. This fee is subject to change. Thus, candidates always need to read the registration form of the Bar Council of Gujarat.

No, there is no negative marking in the All India Bar Examination (AIBE).  For each correct answer, one marks will be given. But for wrong or unattempted question no marks will be deducted.

The AIBE Exam is no longer conducted in open-book format. Candidates will be allowed to carry only bare acts without notes.
